Brazil’s Supreme Court of Justice votes against Lula.

BRAZILIA, Brazil. – The President of the Supreme Federal Court, Carmen Lucia, avoided this Wednesday the Magna Carta and determined with her vote the possibility of anticipating prison to former President Luiz Inacio Lula da Silva.

By 6 votes to 5, that instance denied the preventive habeas corpus requested by the defense of Lula, sentenced to 12 years and one month in prison by the Federal Regional Court of the fourth region, which contrary to the Constitution ordered the execution of the sentence when the resources in second instance were exhausted.

Carmen Lucia accompanied the vote of the case’s rapporteur, Minister Luiz Edson Fachin, who spoke against the grant of habeas corpus, as his colleagues Alexandre de Moraes, Luis Roberto Barroso, Luis Fux, and Rosa Weber also did.

Weber was considered a key piece in the judging, as analysts understood that her position was an unknown, so she would define the vote.
